Exception for elderly and disabled households: Households with at least one member age 60 or older, or a member receiving qualifying disability benefits, are exempt from the gross income test entirely. Only the net income test applies to them, with no cap on the shelter deduction.


New York SNAP Asset Limits

Under New York’s BBCE policy, most households have no asset limit. Bank accounts, savings, and investments are not counted for standard eligibility.

Exception: Elderly or disabled households that exceed the 200% FPL gross income limit and apply under standard eligibility rules face an asset cap of $4,500. Assets that are never counted include your primary home, household goods, personal belongings, retirement accounts, and most vehicles.


Who Qualifies for SNAP in New York

Residency

You must be a New York State resident. No minimum duration of residency is required.

Citizenship and Immigration Status

  • U.S. citizens are fully eligible
  • Lawful Permanent Residents with 5 or more years of U.S. residency are eligible
  • Refugees, asylees, and certain other qualified immigrants may be eligible immediately

Work Requirements for New York SNAP

Under the One Big Beautiful Bill Act (signed July 4, 2025), SNAP work requirements now apply to able-bodied adults without dependents (ABAWDs) ages 18 through 64 — raised from the previous cap of 54. Qualifying adults must work at least 80 hours per month, participate in qualifying training, or live in a county with an active ABAWD waiver.

New York SNAP Deductions

New York City’s extreme housing costs make the shelter deduction one of the most impactful tools for New York SNAP households. The deductions below apply statewide, but their effect is most pronounced in high-cost markets.

Standard deduction: A flat monthly deduction for all households — approximately $204 for households of 1 to 3 members, with higher amounts for larger households. No documentation required.

Earned income deduction: 20% of all gross earned wages and self-employment income is automatically deducted. This benefits New York’s large low-wage hospitality, retail, and service workforce, including restaurant workers, hotel staff, and domestic workers.

Shelter deduction: Housing costs (rent or mortgage plus utilities) exceeding 50% of net income after other deductions are deductible, capped at approximately $712/month for most households. The cap does not apply to elderly or disabled households. In New York City — where median rents regularly exceed $3,000/month — the uncapped shelter deduction for elderly and disabled households is especially significant.

Dependent care deduction: Childcare or adult care costs paid so a household member can work, look for work, or attend school are fully deductible.

Medical expense deduction: Elderly (60+) or disabled members can deduct out-of-pocket medical costs exceeding $35/month — prescriptions, Medicare premiums, doctor visits, and medical transportation all count.

Child support deduction: Court-ordered child support paid to someone outside the household is fully deductible.

New York-Specific SNAP Programs and Features

myBenefits Portal

New York processes SNAP applications, renewals, and case changes through the myBenefits SNAP portal at mybenefits.ny.gov. You can apply entirely online, check your application status, and manage your case without visiting an office.

NYC vs. Upstate New York

New York City residents apply through NYC HRA (Human Resources Administration) rather than through the standard statewide OTDA county office system. The eligibility rules and benefit amounts are identical statewide, but the office system, interview process, and case management differ between the five boroughs and the rest of the state. NYC HRA operates dedicated SNAP centers and accepts applications online through ACCESS HRA at a.hric.nyc.gov.

Benefit Deposit Schedule

  • Upstate New York: Benefits are deposited on the day of the month corresponding to the last digit of your case number (for example, a case ending in 3 is deposited on the 3rd)
  • New York City: Benefits are deposited across 13 staggered days over the first two weeks of the month, per OTDA’s published schedule

Restaurant Meals Program

New York operates a Restaurant Meals Program in some counties, allowing elderly, disabled, and homeless SNAP recipients to use their EBT card at authorized restaurants. How Long Does New York SNAP Approval Take?

Standard processing takes up to 30 days from the date of a complete application.
